The Prosecutor
is the statutory representative for Erie County governmental entities,
including all county agencies, county elected officials, library
districts, State Fire Marshals and townships and school districts as
required. A total of 173 public entities are represented by the three
member Civil Division. In the most recent year, the Division issued over
200 written opinions, attended more than 25 administrative hearings and
90 general governmental meetings, and represented the interests of 14
statutory entities in 28 administrative and federal/state court
proceedings. The Civil Division responsibilities require attendance at a
variety of board meetings, often held in the evening. The Division aids
in the collection of unpaid real estate taxes on behalf of Erie County
Treasurer, and in advising the Erie County
Auditor and
Treasurer on the collection of personal property taxes.
Sandy J. Rubino - Chief Assistant
Prosecutor, Civil Division
Born in Akron, Ohio and raised in Cuyahoga Falls, Ohio, Sandy graduated
from the University of Akron in 1975 with a B.A. in Political Science
and in 1978 from the University of Akron School of Law with a Juris
Doctor degree. While at the School of Law he was a member of the
National Moot Court team and an Associate Justice of Bracton’s Inn.
Sandy has been a lawyer for 30 years both in private practice and in
government. He joined the staff of the Erie County Prosecutor in July
2005. He was previously employed by the Summit County Prosecutor’s
Office where he was Chief Assistant Prosecutor-Civil Division. He has a
wide range of both practical and legal experience in government. He has
served the public as a City Councilman for Cuyahoga Falls, Ohio for nine
plus years and as an acting judge in the Cuyahoga Falls Municipal Court.
He has represented county government in cases before the Supreme Court
of Ohio, 9th District Court of Appeals, United States District Court and
the Federal Sixth Circuit Court of Appeals. He has lectured in areas of
2506 Appeals, Ethics in Government and Annexation. He has also worked in
the Criminal Division of the Erie County Prosecutor's Office handling
felony cases.
Gary Lickfelt - Commissioners' Counsel
Gary was admitted to the Ohio Bar in 1973 and has been an assistant
prosecutor since 1974. He was admitted to the U.S.D.C., Northern
Division on June 6, 1980 and the Sixth Circuit Court of Appeals in 2003.
He represents the Erie County Board of Commissioners, its staff, and
other elected officials in County and Township government in the areas
of resolution drafting, document interpretation, contract construction
and administration, road/sanitary sewer projects and advocates in
federal and state courts for County entities.
Trevor Hayberger - Assistant Prosecutor
Trevor graduated in 1998 from Bowling Green State University with a B.S.
degree in Criminal Justice with a minor in Sociology. He graduated from
The University of Toledo College of Law in 2002. In law school he was
awarded the Reinberger Honors Program in Prosecution and named to the
2002 “Who’s Who Among American Law Students.” After graduating law
school, and a 9 month hiatus as a stay-at-home father, Trevor was hired
as the Juvenile Prosecutor for Erie County in 2003.He has tried many
cases, both misdemeanor and felonies, and was one of the founding
members of the Juvenile Drug Court. Today, Trevor is the County Court
Prosecutor, Adult Drug Court Prosecutor, and Assistant Prosecutor for
the Civil Division as well. Trevor is actively engaged in many social
and political activities as well, and is on the Board of Directors for
the Home of Hope.
Trevor Hayberger is a lifelong resident of Erie County. He is currently
a resident of Sandusky. Trevor is married to Wendy and the father of two
young boys.
